VEHICLE USE
The lessee receives the rented vehicle and accessories described in the contract in perfect working condition and undertakes to preserve them and comply with the rules of the Highway Code. The following are expressly prohibited: Transporting people or goods when this directly or indirectly implies subletting the vehicle. Driving the vehicle by unauthorized persons. Driving the vehicle under impaired physical conditions caused by alcohol, drugs, etc. Driving the vehicle on forest tracks, beaches, or unpaved areas (except for 4×4 vehicles). Carrying more passengers than those authorized in the vehicle’s technical documentation. Using the vehicle in any kind of sports competition, for towing or pushing other vehicles, or for driving instruction purposes.
VEHICLE RETURN
The vehicle must be returned at the place, date, and time stipulated. In case of delay, the first two extra hours are free of charge. From the 3th hour onward, the full daily rental rate will apply.
LEASE SETTLEMENT
The lessee agrees to pay, in addition to the charges listed in the contract, any expenses incurred due to: Loss or theft of keys, accessories, tools, spare tire, battery, or documentation. Fines for traffic code violations and towing expenses due to improperly parked vehicles. Damage to the vehicle’s underbody, punctures, or damage to tires, as well as burns or stains on the upholstery. Fueling with the wrong type of fuel.
INSURANCE COVERAGE
The insurance contracted by the Lessor covers the lessee and authorized drivers under this agreement for third-party liability (up to €50 million), unlimited medical assistance at recognized medical centers (C.C.S.), and up to €1,800 in centers of the driver’s choice. It also covers legal defense and bonds that may be required of the driver. The lessee’s liability for damage to the rented vehicle is limited to the applicable deductible, as per the current rate. The lessee may opt to waive said deductible in passenger vehicles by paying an additional charge. Loss, theft, or damage to goods transported in the vehicle are expressly excluded from coverage.
ACCIDENTS
In the event of an accident, the lessee must: Not move the vehicle from the scene until the competent authority arrives and prepares the official report. Immediately notify the Rental Company of the incident. Not reach any agreements with the other party regarding the accident. Not abandon the damaged vehicle without first taking the necessary precautions to prevent further damage or loss. Obtain all relevant details from the other party involved, including the driver’s identity, owner, vehicle, and insurance company.
REQUIREMENTS
Upon vehicle delivery, it is mandatory to present a valid National ID or Passport and a valid driver’s license.
NEGLIGENT DRIVING
The lessee who operates any of the Company’s vehicles under the influence of narcotic drugs, alcoholic beverages, or any other condition that impairs mental faculties shall assume full responsibility for any damage caused to the vehicle, as well as to other vehicles, persons, property, animals, or third parties in general. The driver under the aforementioned conditions shall also be liable for any transported persons or goods and any penalties incurred. In the event the rented vehicle becomes unusable due to an accident under such circumstances, the lessee shall not be entitled to a replacement vehicle or to any refund. JURISDICTION For any issues arising from the execution or enforcement of this contract, the parties expressly submit to the jurisdiction of the Courts and Tribunals of the Province of Santa Cruz de Tenerife, expressly waiving any other jurisdiction that may apply.
TERRITORIAL SCOPE
It is strictly prohibited for lessees to remove the rented vehicle from the island where the contract is executed, unless authorized by the rental company. Failure to comply with this prohibition shall result in the immediate termination of the contract, and the lessor may pursue any legal actions deemed necessary before the appropriate courts. REGULATIONS Personal data provided shall be processed in accordance with Organic Law 15/99 of December 13 on the Protection of Personal Data and its implementing regulations. The client may at any time access, rectify, or cancel their data by sending a request via email or regular mail to the company.
